Terms of Use
Preamble
Manu Assistant is assistance software intended to help professionals and organisations lawfully practising physiotherapy or osteopathy in France to structure, write, organise and maintain traceable records of certain aspects of professional follow-up. The Service includes the calendar and patient record, document drafting assistance, exercise programme preparation, review of feedback in Théra and video consultations. In particular, it can assist with note-taking, transcription and preparing assessments, clinical reports, patient messages and letters to doctors.
Manu Assistant is an assistance tool. It never replaces the examination, reasoning, decision or approval of the professional user.

Article 2 — Purpose
These Terms of Use define the conditions for access to and use of the Service by Clients, Professional Users and Patient Users in their respective spaces.
Article 3 — Professional access and patient access
The Manu practitioner workspace is reserved for professionals, practices and organisations working in physiotherapy, osteopathy or related activities compatible with the Service's purpose. A patient must not use their practitioner's professional credentials.
An invited patient uses Théra with their own access. They can view their programme and shared instructions, report how they feel and complete questionnaires, find appointments and join a video consultation when their practitioner offers one. This access does not constitute a subscription to the professional plan and does not provide access to other patients' data.
Rules on access security, authorised use and data protection apply to both spaces. Clinical approval obligations and subscription terms apply to the professional. Use by an unauthorised third party remains prohibited.
Article 4 — Account creation and access security
Each user has personal access. The patient logs in to Théra using the email address used for their invitation and the temporary code received; they must not share this code with a third party. The Client is responsible for granting and withdrawing access for its Professional Users and for compliance with the internal security rules applicable within its organisation.
The Client and Professional and Patient Users undertake to keep their credentials confidential, enable the protections offered where available, secure their devices and promptly report any suspicious access to contact@manuassistant.com.
Article 5 — Description of the Service and conditions of use
In Manu, the practitioner organises appointments, views the history and progress assessment, prepares and reviews documents, then selects exercises, instructions, schedules and questionnaires to share in Théra. AI suggestions are proposals to review and adapt. Importing Doctolib appointments is voluntary; it does not constitute continuous synchronisation between the services.
The video consultation enables a session between a practitioner and an adult patient, after authentication and admission by the practitioner, within the limits set out in the Terms of sale. No audio or video recording is enabled within this scope. The professional assesses whether remote follow-up is appropriate and obtains the necessary consent.
Mandatory human approval: every Output must be reviewed, checked, corrected where necessary and approved by the professional before being added to the record, shared, transmitted or used in care.
The Service does not provide a diagnosis or prescribe, and does not replace clinical judgement, professional obligations or the practitioner's duty to provide information.
Article 6 — Audio recording
When Audio is used, the Professional User undertakes to inform the person concerned and, where required by the context of use, obtain their prior agreement. Refusing recording must not prevent care; the Client can then use the Service with notes, dictation or manual entries.
Any recording that is concealed, used for a purpose other than its professional purpose or made in breach of a legal or ethical obligation is prohibited.
Article 7 — Data minimisation and good practice
The Client and Professional and Patient Users undertake to enter only data strictly necessary for the intended purpose. Where possible, it is recommended to avoid dictating or entering unnecessary direct identifiers and to favour internal references compatible with the practice's organisation.
Article 8 — Audio processing and content generation
Audio, when used, is intended for transcription and then the generation of assistance content. It is automatically deleted after processing, with a target of prompt deletion, normally within 24 hours at the latest, except in the event of a documented technical incident, legal requirement or justified security need.
Before any transmission to a technical or artificial intelligence provider, data minimisation measures may be implemented depending on the configuration and state of the art. The Client is informed that some technical providers may retain technical logs for a limited period for security, abuse prevention or maintenance purposes.
Article 9 — Availability, maintenance and changes
The Publisher is subject to an obligation to use reasonable endeavours. Interruptions may occur for maintenance, corrections, security or updates. The Publisher may change the Service and its features, provided it does not substantially alter its purpose without a legitimate reason.
Article 10 — Intellectual property
The Publisher retains the rights relating to the Service, its architecture, interfaces, trademarks and documentation. The Client retains its rights to the content it enters and grants the Publisher a licence limited to what is strictly necessary to perform the Service.
Article 11 — Prohibited conduct
The following are prohibited in particular: unauthorised access sharing, misuse of the Service, reverse engineering except as permitted by law, bulk data extraction, unauthorised load testing, unlawful use, compromising the Service's security or collecting data without a lawful basis.
Article 12 — Suspension
The Publisher may suspend all or part of access to the Service in the event of a security risk, manifestly unlawful use, a serious breach of these terms or non-payment, under the conditions set out in the Terms of Sale.
Article 13 — Liability and warnings
Outputs may contain inaccuracies, omissions or errors. The Professional User remains solely responsible for checking and approving content and for decisions made on its basis. The Service must be used as an assistance tool, not as an autonomous decision-making system.
Article 14 — Personal data
Data processing is described in the Privacy policy and, for data entrusted by the professional, in theGDPR Data Processing Annex. The patient information notice distinguishes consultation audio, Théra and video consultations. The account deletion procedure distinguishes closing access from what happens to records retained by the practice.
Article 15 — Governing law and jurisdiction
These Terms of Use are governed by French law. Unless mandatory law provides otherwise, any dispute falls within the jurisdiction of the competent courts of Paris.
Article 16 — Amendments
The Publisher may amend these Terms of Use to reflect legal, regulatory, technical or functional developments. The applicable version is the one in force on the date the Service is used.
